Wash sales for international investors trading US stocks

Should a non-us citizen who uses a third-party broker (my bank doesn't specify) be worried about wash sales? Would penalties still apply if the broker is American? I'd like to rebalance by portfolio (shave down number of ETFs into 2) but worried because they probably count as "Substantially similar" securities.
