Bloomberg Reports Appeals Court Revives Tylenol Autism Lawsuits Against Kenvue (NYSE: KVUE)
Bloomberg reports that a US federal appeals court has revived lawsuits alleging that Kenvue Inc. failed to disclose purported risks associated with taking Tylenol during pregnancy.
The claims allege that prenatal exposure to the over-the-counter pain reliever may be linked to autism and other developmental conditions in children. The allegations remain disputed and have prompted significant debate within the medical and scientific communities.
According to Bloomberg, a three-judge appeals panel in New York ruled on Monday that the lower court had gone too far when it excluded testimony from three expert witnesses presented by the plaintiffs. The case has now been sent back to the lower court for further proceedings. The appeals court upheld the exclusion of two other experts.
A federal judge in Manhattan had previously prevented approximately 500 cases from proceeding to trial in 2023, finding that the scientific evidence relied upon by the plaintiffs was insufficient.
The latest ruling does not determine whether Tylenol causes autism. Instead, it allows the litigation to continue and gives the plaintiffs another opportunity to present parts of their expert evidence.
The decision represents a legal setback for Kenvue, the consumer-health company spun off from Johnson & Johnson. **Bloomberg Intelligence estimated earlier this year that the company could face thousands of additional claims and potentially substantial settlement costs.**
Kenvue did not immediately respond to Bloomberg’s request for comment.
